Terms and Conditions

• In the these terms and conditions, the company Fivemotion, Lda will be referred to as 5emotionsalgarve, its commercial name.
  
• There are not marked seats. All of our passengers are seated by our crew in the best way to guarantee the maximum safety, comfort and satisfaction;
  
• Check-in needs to be done 30 minutes before the activity, at the 5emotionsalgarve desk, at the Marina de Portimão;
• VAT included at the current legal rate;
• Boarding times may change due to constraints beyond 5emotionsalgarve's control;
• 5emotions reserves the right to change the Retail Selling Price (RSP);
• 5emotionsalgarve is not responsible for the loss of personal property on board the vessels;
• 5emotionsalgarve is not responsible for the actions of passengers that may result in personal injury or injuries to others on board as a result of inappropriate behavior or failure to comply with the instructions of the crew;
• Check-in / boarding will be denied to customers who present themselves with inappropriate or offensive clothing and / or under the effect of alcohol or narcotics;
• It is forbidden to bring drink and/or food on board, except for baby food (up to 3 years old);
• Not suitable for pregnant women and people with neck and/or back problems;
• Children under 16 must be accompanied by a responsible adult;
• With the purchase of the ticket, 5emotionsalgarve is authorized to capture and disseminate the photographs obtained within the scope of the event organized by itself to which the ticket refers. If you do not authorize the collection and use of photographs and/or videos with your image, you must, for this purpose, make this express declaration at the check-in counter;
• Our vessel complies with European safety standards;
• Our company 5emotionsalgarve, has all mandatory insurance, being licensed by Turismo de Portugal (RNAAT Nº 70/2021);
• The personal data collected by 5emotionsalgarve during the reservation process, are intended solely and exclusively for the processing and check-in of the client. The customer's data will not be used for any other purpose, unless the customer authorizes the use of the data for the purposes of Email Marketing;
• Entry to the caves is subject to prohibition by the Local Marine Police, due to poor sea conditions;
• Due to local regulations, the vessel can only stay in the Benagil Caves for a few minutes. It is not permitted to leave the vessel;
• The stop for a swim is only possible if the sea conditions allow it.
  
  

SIGHTING GUARANTEES

• On our Dolphins and Seabirds Experience, we cannot predict whether it will be just dolphins or whales (cetaceans), just birds or both seen on a single tour, as they are wild animals in their natural habitat and their behavior is unpredictable. However, we guarantee the sighting of at least one species of Dolphin or whale or Bird listed for the Algarve region. If no cetaceans or seabirds are seen during the tour, the customer will have the possibility of taking another free tour on a date to be agreed, or in case of unavailability due to sea/atmospheric conditions, they will be entitled to a full refund;
• In other activities, failure to see dolphins does not entitle you to a refund or rescheduling of the trip, however we are committed to doing our best in searching for them;
• Errors in the information provided or published by third parties are not the responsibility of 5emotionsalgrave.
  

CANCELLATION POLICIES

• If you want to cancel your reservation, you must do so 24 hours in advance of the experience. Canceling within the 24 hour period does not grant the right to a refund, except on presentation of medical evidence;
• If the customer chooses to reschedule their experience on the period of the 24h before departure, for a later date than the one initially booked, the new date is not protected by our cancellation policy, and they are not on the right to ask for a partial or full refund;
• Failure to check-in within the defined period does not grant the right to a refund or rescheduling of the trip;
• In the event that 5emotionsalgarve cancels your experience due to sea-weather conditions or unforeseen circumstances, an alternative date will be offered. If this change is not possible, a full refund will be made;
• Tours subject to a minimum number of 20 passengers.
